百好乳品厂创建于1926年是我国第一家乳品厂,创始者------吴百亨,我国乳品工业的奠基人。创办之初,他就瞄准英瑞公司名牌产品鹰牌炼乳,创建我国名牌产品白日擒雕牌炼乳,与之相抗衡。因产品质量优异,使企业站稳了脚跟,并且获得发展,打破了外商垄断我国炼乳市场的局面。

在二十年代的中国市场上,国产炼乳加工业还是个空白,而号称王牌的英帝国纳司尔英瑞公司生产的飞鹰牌炼乳却随处可见。在兴办国货、创立实业的“五四”爱国精神鼓舞下,1926年秋,浙江温州的民族资本家、著名实业家吴百亨先生独资创办了中国第一家炼乳厂----百好乳品厂。为了使自己的产品尽快打入市场,针对当时英瑞公司的飞鹰牌炼乳独霸市场的局面,吴百亨先生为自己的产品精心设计了“白日擒雕”商标。雕、鹰同属猛禽类,商标中有了擒雕腿的图案,含有不让这只外来苍鹰在中国市场上恣意横飞之意。

在吴百亨先生的努力下,擒雕牌炼乳很快取得了顾客的信任。1929年擒雕牌炼乳在工商部主办的中华国货展览会上获得一等奖,翌年又在西湖博览会上获特等奖。于是擒雕牌炼乳名声大振,从温州地区发展到全浙江,进入江苏、福建等省市场,成为英瑞公司的劲敌。

英瑞公司发现市场上出现擒雕牌炼乳后,不禁大为光火,马上提出申诉。由此,一场长达十年的争夺商标权斗争开始了。

英瑞公司提出:白日擒雕商标系仿冒鹰牌商标的产物,两种商标虽有差别,但主要部分均以飞鹰为标识,易引起误会。并蛮横提出:凡用类似老鹰之鸟类的商标的,均有误认为飞鹰牌的可能,故要求撤销擒雕商标权。

面对英瑞公司的无理指责,吴百亨先生据理力争。他指出:日本人曾发行鹫鸟牌炼乳,也是以类似老鹰之鸟为商标,未闻不准并行于世之说。他以利害关系人身份提出反诉,指出应依法撤销商标的恰恰是英瑞公司本身。

原来,1926年底,国民党政府商标注册局成立后曾发出通告,要求所有曾在北洋政府注册的外国商标,必须在6个月内重新向南京政府登记,否则无效,百好厂正是值此时机登记注册的,并将商标图案在商标公报上作了公布。按国民政府商标法规定,6个月内如无提出异议,即发给商标注册证。当时的英瑞公司根本没有把新成立的国民政府的法令放在眼里,所以直到6个月过后,也没有提出异议。百好厂因而依法获得了商标权。当英瑞公司看到百好厂对自己的潜在威胁提出申诉时,为时已晚。法庭仅判两个商标同时并行。1930年,英瑞公司再次上诉,但结果还是以败诉告终。

英瑞公司在商标权案败诉之后,更加恼羞成怒,便接二连三地向百好厂发难。先是用卑劣的手法破坏“白日擒雕”炼乳的声誉,接着又提出用10万收买“白日擒雕”商标权。然而,面对实力雄厚的英瑞公司,吴百亨先生的回答是:“我办百好厂,是为兴办国货,‘白日擒雕’商标权我绝不出卖。”

为了兴办白日擒雕牌炼乳,抵制洋货。吴百亨决心进一步扩大生产,认定取得稳定而丰富的乳源是第一要着。他从一个贩卖乳酩饼的农民那里获得一条重要信息:离温州市百余里的瑞安县(现改为市)马屿区,养水牛的很多,这种优良水牛既能役用,又能挤奶,奶质也好。他亲往实地调查,果然如此。他大喜过望,于1930年把厂子迁到马屿区沙羊那里租屋生产,并购地建造新厂房。厂房是按照美国出版的《炼乳和乳粉制造法》一书的要求设计的,并预留日后发展的余地,于1932年建成。同时,又陆续向国外订购真空蒸发锅、鲜奶预热器、炼乳冷却器、奶油搅拌机和冷冻设备等,于1934年安装就绪,使百好厂实现从秤量槽、脂肪分离、砂糖混合、真空蒸煮、强制析晶到机械装罐等十六道工序的系统化和半机械化,成为初具现代化规模的乳品工厂。由于经营方法得当,同时聘请了毕业于美国康尼尔大学乳品专业的许康祖来厂工作,百好厂得到迅速发展,质量得到保证,‘白日擒雕’牌炼乳销量与日俱增,年营业额80余万元。1941年,温州被日寇占领,百好厂被迫停工。吴百亨在《回忆》中曾说过,30年代是百好厂的“黄金时代”。解放以后,为重图发展‘白日擒雕’炼乳,在各方的共同努力下,百好厂在1950年重新复工,百好厂的产品开始正式出口。生意便越做越兴隆,生产规模也逐渐扩大,1953年总产值累计32.9万元,1954年工业总产值累计为176.37万元。

百好厂在党和政府领导下,胜利地实现了公私合营,基本上成为社会主义性质的企业,受到社会各界人士的支持和关心。

1958年开始,百好厂受浙江省粮油进出口公司委托组织生产出口“熊猫”牌甜炼乳,由于利用先进的加工技术,严格的质量把关,经过几十年的努力,使“熊猫”牌甜炼乳畅销全国各地,远销东南亚十几个国家和地区,出口量占全国甜炼乳出口量的50%以上。就这样,“熊猫”牌甜炼乳成为百好厂的成员,与“擒雕”牌一起发展,共同进步,成为百好厂发展的两大产品。而“擒雕”牌甜炼乳,由于其悠久历史,已深深的扎根在人们的心中,并荣获多项荣誉:如1979年获省优质产品奖,1983年分别荣获外经贸部荣誉证书,轻工业部优质产品,国家银质奖(最高质量奖),1990年首届全国轻工业博览会金奖,1991年第二届国际博览会金奖;与此同时,“熊猫”牌甜炼乳也获得了多项荣誉,在市场走向成熟后,九六年一月浙江省粮油进出口公司撤走“熊猫”牌商标,百好厂从此不再生产“熊猫”牌甜炼乳。

In order to make his products enter the market as soon as possible, in view of the situation that Yingrui's Feiying brand milk refining dominates the market at that time, Mr. Wu baiheng meticulously designed the trademark of "day capture carving" for his products. When Yingrui company found out that there was a "catch and carve" milk refining in the market, it couldn't help being furious and immediately filed a complaint. Thus, a decade long struggle for trademark rights began. Yingrui company proposes that the trademark of Dayi Jiediao is a product of imitating hawk brand. Although there are differences between the two kinds of trademarks, the main part of them are marked by flying eagle, which is easy to cause misunderstanding. He also proposed that anyone who uses the trademark similar to the eagle bird mistakenly believes that it is possible to use the flying eagle brand, so he asked for the cancellation of the trademark right to capture and carve. In the face of unreasonable accusations from Yingrui company, Mr. Wu baiheng argued. He pointed out that: the Japanese once issued the jiuniao brand condensed milk, which is also a trademark similar to the eagle bird, which is not allowed to be used in the world. He raised a counterclaim as an interested party and pointed out that it was the company itself that should revoke the trademark according to law. It turns out that at the end of 1926, after the establishment of the trademark registration office of the Kuomintang government, a notice was issued that all foreign trademarks that had been registered with the Beiyang government must be registered with the Nanjing government again within six months, otherwise they would be invalid. Baihaochang registered at this time and published the trademark pattern in the trademark bulletin. According to the Trademark Law of the national government, if there is no objection within 6 months, a trademark registration certificate will be issued. At that time, Yingrui did not take the newly established national government's decree seriously at all, so it did not raise any objection until six months later. Baihao factory thus obtained the trademark right according to law. It was too late for Yingrui to see Baihao plant file a complaint against its potential threat. The court ruled that only two trademarks were in parallel. In 1930, Yingrui company appealed again, but it lost. After losing the trademark case, Yingrui became even more angry, so it repeatedly attacked Baihao factory. First, the reputation of milk refining of "day capture carving" was damaged by mean of despicable means, and then the trademark right of "day capture carving" was bought by 100000 yuan. In 1941, Wenzhou was occupied by Japanese invaders and Baihao factory was forced to shut down. Wu baiheng once said in memory that the 1930s was the "golden age" of Baihao factory. After liberation, with the joint efforts of all parties, Baihao factory resumed work in 1950, and its products began to be officially exported. In 1953, the total output value was 329000 yuan, and in 1954, the total industrial output value was 1763700 yuan. Under the leadership of the party and the government, Baihao factory has successfully realized the public-private joint venture, basically becoming a socialist enterprise, supported and cared by people from all walks of life. Since 1958, Baihao factory has been entrusted by Zhejiang grain and oil import and export company to produce and export "Panda" brand sweetened condensed milk. Due to the use of advanced processing technology and strict quality control, after decades of efforts, the "Panda" brand sweetened condensed milk has been sold all over the country and exported to more than ten countries and regions in East and South Asia, with the export volume accounting for more than 50% of the national sweetened condensed milk export volume. In this way, the "Panda" brand sweetened condensed milk has become a member of Baihao factory, developing together with the "escapement" brand, making common progress and becoming the two major products of Baihao factory. Because of its long history, tangdiao brand sweetened condensed milk has been deeply rooted in people's hearts and won many honors: for example, it won the provincial high-quality product award in 1979, the honorary certificate of the Ministry of foreign trade and economic cooperation in 1983, the high-quality product of the Ministry of light industry, the national Silver Quality Award (the highest quality award), the gold award of the first National Light Industry Exposition in 1990, and the gold award of the second International Exposition in 1991; At the same time, "Panda" brand sweetened condensed milk also won many honors. After the market matured, in January 1996, Zhejiang grain and oil import and export company withdrew the "Panda" brand trademark, and Baihao plant no longer produced "Panda" brand sweetened condensed milk.
